We are the Irricontrol Controle Inteligente de Irrigação S.A., a company registered with the CNPJ/ME under number 26.941.490/0001-14, with registered office at Rua Vital Brasil 65, Bairro São Vicente, Itajubá/MG, CEP 37502-098, hereinafter simply "Irricontrol or "We"Irricontrol is part of the Bauer Group, controlled by BAUER DO BRASIL SIST. Irricontrol is part of the Bauer Group, controlled by BAUER DO BRASIL Sist. de Irrigação e Trat. which is also the controller of your personal data.

This means that we make decisions about what data we collect from you, where and how we store it, how we process it, and so on - all in accordance with our Privacy Policy below (a "Politics").

This Policy aims to inform you transparently and collect your free, express, informed and unambiguous consent for the processing of your personal data, which is collected from you:

Register and use our Irricontrol irrigation automation platform (our "Platform");
You enter our site and use one of the services offered there, such as a demo or downloading one of the e-books we offer (collectively, our "Site");
Ask us for a quote;
Contact us for technical support;
Requests the start of a maintenance or warranty process for an Irricontrol product;
You fill in one of our forms to take part in some virtual action or otherwise provide us with personal data when explicitly requested to do so by us.

Each of the above may be referred to as an Irricontrol "Service". Your personal data, i.e. information that identifies you or may identify you, as defined by the applicable legislation, in particular the General Data Protection Act (LGPD), may be collected and processed by us under the terms of this Policy. You represent and warrant that all personal information you provide to us is true, current and complete.

2. Data collected

When you use any of our Services, we will collect the following data:

Visitation and interaction data: When You visit our Site, we will collect cookies from Your computer (for more information about cookies, see the "Cookies" section below), Your clicks on the page and browsing interactions, Your location via IP address, browser type, type of device You use to access the Site, operating system of the device used and country of origin of Your access. Platform registration and use data: When you register on the Platform or if you have already sent us this data in another way prior to your registration, we will collect the data requested there, such as your name, CPF, e-mail address, telephone number and contact address. We collect information about your interactions on the Platform, such as your browsing, the pages or content you access or create. We may request access to your camera and microphone, exclusively for the purposes of interacting with advanced functionalities on our Platform. Irricontrol automatically collects application access logs that include the IP address with date and time used to access the Platform. This data is mandatory according to Law 12.965/2014;

Third party data on the Platform: If You are an administrator of Your farm on the Platform, You can add users to Your farm. By adding someone, You will provide us with their name and email address so that Irricontrol can send them an invitation to register on the Platform. By doing so, You represent and warrant that this person is aware of and consents to being invited to the Platform. If You are aware of any reason why your colleagues might, even potentially, not want their information shared via the Platform, You undertake not to share such information, releasing Irricontrol, including by way of recourse, from any liability in this regard;

Communications with Irricontrol: When you communicate with Irricontrol, we collect information about your communication, including metadata such as the date, IP address and time of communications, as well as all your content, as well as any information you choose to provide us with;

Cookies and similar technologies: We use cookies, which are text files generated and stored on your browser or device on our Site. Cookies may be used to authenticate your session, remember your preferences and settings and understand, in aggregate and anonymized form, the behavior and interests of users on our Site;

Payment details and budget: When You make a payment to Irricontrol or request a quote from us, for example within the Platform itself, You will provide us with bank details, such as your financial contact and billing address, invoice and means of payment, credit card number, social security number, among other information explicitly requested at the time of the payment or quote. Support, maintenance or warranty data: When you contact us to request technical support or the start of a maintenance or warranty procedure for an Irricontrol product, we will collect the data explicitly requested at that time, such as your name, email address and address, and use it for the specific purpose of processing your request. Unless you have unequivocally consented to this Policy, your data will only be used for this purpose, in compliance with and on the legal basis of the fulfillment of the contract we have entered into between us. Your data collected in this way may be cross-referenced with data we have about you from other sources, respecting these purposes.

3. Use and Sharing of Your Information

General purpose: We value your privacy. That's why all data and information about You is treated as confidentialand we will only use it for the purposes described here. Your personal data will be used for the actual provision and operation of the Service in question, in addition to the other purposes set out below;

Other purposes: We may use your name and e-mail address to send you information about Irricontrol, as well as other institutional communications and alerts, and to send you Irricontrol marketing campaigns. We may also use your data to manage your contracts and budgets with Irricontrol, such as invoices, annuities, etc., and to add you to our list of leads (potential clients) for future contacts with you, always under the terms of this Policy. In our leads system, we may use your name, the name of your farm or the farm where you work, e-mail address, billing address, delivery address and CPF;

Budgeting system: As a rule, we process very little personal data in our quotation system. If the company where you work asks us for a quote, we will use the name and e-mail address of the person responsible for the sale to process the requested quote. In this case, unless you have legitimately consented to this Policy, in which case your data may be used for all the purposes described here, only this data will be collected, and only for the purpose of fulfilling the quotation request under the legal basis of contract fulfillment. Our quotation system is integrated with different WordPress and WooCommerce plugins so that we can manage your information and contact You, exclusively for the purpose of processing the quotation in question;

Third-party software used: Our platform is integrated with Microsoft Azure and with Googleso that we can use the login information from these platforms and enable You to register and log in to the Platform. Our Platform is also integrated with ZenDesk and with iCropHowever, we do not share your personal data with these partners, except if you contact their support service, in which case you will share with them the data requested at the time of contact, such as your name and e-mail address. Our website is integrated with Google reCAPTCHA v3which seeks to distinguish human access from automated access, and also with plugins from WordPressThe Platform is used to manage backups of the Site, send transactional e-mails, export information from our systems, among other related functionalities, and may have access to all personal data that You provide through our Site. Our Site and Platform use the Google Analytics for traffic analysis and application of improvements, SEO (Search Engine Optimization) and related functionalities, with the possibility of Google have access to your interactions when using the Platform or Website. Our Platform, Website and Quotation System are integrated with the SendGrid for sending transactional emails and updates on orders, with which we only share your name and email address. All these platforms can use your data for their own purposes, including targeted marketing - therefore, we recommend that you contact their own privacy policies if you would like to know more about the processing of your personal data by the companies mentioned;

Controller: As mentioned, we process your personal data together with our parent company, BAUER DO BRASIL Sist. de Irrigação e de Trat. Ltda. Therefore, your personal data may be cross-referenced with information that you have legitimately shared with Bauer, and may also be shared with Bauer as indicated above, for the purposes set out in this Policy or for legitimate purposes that Bauer may exercise;

No sharing: Unless otherwise stated in this Policy, no personal data about you will be shared by Irricontrol with any third parties, such as business partners or other companies;

Judicial request: Irricontrol reserves the right to provide data and information if requested to do so by a court of law, exclusively to the extent that such sharing is required by law;

Anonymized data: We may also anonymize your data and use it, in aggregate form, for other reasonable purposes, never allowing you to be identified, even later, in order to de-characterize such information as "personal".

4. Other Authorized Uses

We may also use your data to:

Analyze user traffic in our applications;
Detection and prevention of fraud, spam and security incidents;
Complying with legal obligations; and
Monitor the Platform and the Site, mainly to ensure that the rules described in this Policy are being observed, or that there is no violation or abuse of applicable laws.

5. Holders' rights

6. Information Security

All your data is confidential and only people with the appropriate authorizations and needs will have access to it, and only with express authorization and for a limited time. Any use of your personal data will be in accordance with this Policy. Irricontrol will make all reasonable commercial efforts to guarantee the security of our systems and your data. Access to the servers containing your data can only be made through previously authorized communication channels.

To protect your login information on the Platform, you will receive a unique access token each time you want to authenticate your login. All exchanges of information on our Services are encrypted between your device and our servers. Your personal passwords are stored encrypted on our systems. Our servers and their backups are operated and protected by Heroku and Amazon Web Serviceswhich contains its own protection and encryption measures. The information on the website and the quotation system is stored on virtual machines operated by DigitalOcean, which contains its own protection and encryption measures. All these servers are located in the United States of America.

Without prejudice to these deadlines, we will keep your data and information only until it is necessary or relevant for the purposes described in this Policy, or in the event of periods predetermined by law.

Irricontrol considers your privacy to be extremely important and will do everything in its power to protect it. However, we cannot guarantee that all the data and information about You on our Platform will be free from unauthorized access, especially if the credentials required to access the Platform are shared improperly. Therefore, You are solely responsible for keeping your access password and links received for access to the Platform in a safe place, and you may not share this information with third parties. You undertake to notify Irricontrol and the data controller immediatelyby secure means, the regarding any unauthorized use of your accountas well as unauthorized access by third parties.

This document shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. The District Court of Itajubá, Minas Gerais, is hereby elected as the competent court to settle any questions arising from this document, with express waiver of any other, however privileged.
